Those born in the UK

You cannot automatically become a British citizen just by being born in the United Kingdom. You determine your legal status in the UK by checking if you have a British citizen through birth, descent, or residence. You may become a citizen of the UK if you were born here and are not currently a British citizen.

As The Spouse Or Civil Partner Of A British Citizen

If you want to apply as the spouse of a British citizen, you must have lived in the UK for the last 3 years. You will also need either: indefinite leave to remain (ILR) or
settled status under the EU Settlement Scheme

You can apply for citizenship immediately if you satisfy any of the above conditions.

Indefinite leave to remain (ILR)

You can apply for ILR by the time you’ve lived in the UK for five years. You must live in the UK for 12 months after getting ILR before you can apply for citizenship.

‘Settled status’ Under the EU Settlement Scheme

You must have lived in the UK for 12 months to be eligible for settled status.

Did you have permanent status before having settled status?

Citizenship can now only be applied for by those with permanent resident status, not by those holding settled status. Having permanent residence status for 12 months would mean that you would not have to wait for 3 years to apply for British citizenship.

For People Who Already Have ‘Permanent Residence’ Status

British citizenship law no longer allows ‘permanent residence’ applicants to apply. You may still be eligible to apply for settled status if you have not already. The EU Settlement Scheme’s ‘settled status’ could help you get citizenship.

People with limited leave to remain in the UK who applied to the EU Settlement Scheme by 30 June 2021 were granted settled status. If your circumstances prevent you from applying by the deadline, you can ask to apply late.

For People With Commonwealth Citizenship

If you satisfy the following requirements, you may be eligible to apply for citizenship under the Windrush Scheme:

You are eligible for this benefit if you, or one of your parents, moved to the United Kingdom before 1973.
You have lived in the UK for at least two years.

You must qualify these conditions if your parents arrived in the UK before 1973:

You were born in the UK
You were below 18 when they arrived
